You're correct - he does technically own it as he's the first to cross the finish line first. Though it stil a strong showing of disrespect towards the sponsors and Sam Bass for his artwork. Also, that may come out of it as they never did the official presentation of it - therefore in saying that it wouldn't be his due to not being officially given it yet. You can look at it in many different ways - Kyle's POV, Sam bass' POV, NASCAR's POV and the sponsors of the race's POV - either way, they'll come out with a different opinion and when it comes down to the fines, well that's NASCAR's call.
