Should race tracks eliminate king of the Hill due to lack of cages for safety ?

So it is a resonable assumption that the car had another one of those DIY aftermarket seat installations where the seat is mounted to a non reinforced peice of the floor which causes the seat to rip loose during a collision causing serious injury.  If the seat was installed incorrectly then deploying airbags could easily have maimed or killed the driver.  Perhaps the rules should include "factory passive and supplemental restraints required in conjunction with factory seating" that way if some one is injured in such a case the driver of the vehicle is at fault for knowingly circumventing the rules to enter.
However I am not an expert on the law but I think that the whole legal scope changed the very minute they started offering prize money.

PS nitrous nothing more than a bomb waiting to go off in a collision with poorley secured bottles and the very nature of the compressed gas.  That crap could seriously injure the crowd.

Silverstone even though I am a fan of KOH ( Take away sponsor purses ) I back everything you have said reguarding this issue.I hope all KOH tracks  take notice to what happened this weekend at Barrie.This driver got off lucky but the next time this Lord forbids happens again the next person might not be as lucky.The fans like it and I hate to say some want to see accidents and if a serious one (accident ) happens at their track they will all say I didnot know it could happen to us here but remember it can and I hate to say it will happen again.Allowing cars with nitris  on an oval track are they crazy .These type of cars should be on Drag strips not ovals driven by profesionals not rookies.Hope you (tracks ) have good insurance because somebody I hate to say will file a claim against your track if it should happen (waiver signed or not ).

I have to agree with 44 one this one if he Hit the Nitros Button in on a corner there is no way to control FRD steering,,,What happens in the winter on snow on a FWD car when you turn and Throttle it??? It goes straight doesen't it!!!,, I hope he is Going to be OK,But If he trys to sue that track over it He has one hell of a battle ,,Besides he has no merit,and the only ones that will get rich off this are the Lawyers,,I hope he does not even try it,because it will be a waste of time...

Putting aside the fact the driver was hurt, and I hoped this would never happen to anyone participating.

Even if his insurace company were to sue, he wouldn't receive much.
In Canada (and I hope it stays this way) you can only sue for actual damages incurred.

Value of the car???? No air bags, etc etc. ---- lets say    $5000.00

Broken arm - Ont Health pays for just about everything. Crutches etc.  $1000.00
Ambulance ride - $250.00
Loss of work - I'm not sure how long this would be, depends on the type of work etc. Lets say $1000 a week for 8 weeks - $8000.00

Total with misc around $15,000.00

Signed waiver, - track at fault 10% ?  -      Judgment for $1,500 plus legal.
Signed waiver - track at fault 5% ?  -        Judgment for $750.00 plus legal
Any insurance company would underwrite this kind of liability.
It would probably be a small rider attached to the general liability certificate (if any at all)
I'd think their exposure would be alot greater from someone just working in the pits week in and week out.
