For all we know , the legal ramifications of this incident may be completely out of the track managements hands by now.
However the managements response to the incident may just show us what they're really made of. Lack of action or the wrong response may leave them with a bigger problem then they can imagine.
Yes shodowracer I was talking to Barry and the fourteen year old pushed him from the front and Mark Jacobs his brother gave Barry a sucker punch to the back of the head as he was going back from the push
Yeah the details are starting to trickle in. Unfortunately there's more commentary going on Facebook walls than there is here. >:(
Anyway, as much as I couldn't concieve it, looks like that's exactly what happened.
I remember feeling a little bit touched when I read about Jaxson's incident with Gary Elliott up at Sunset. The 1 car somehow got out of control and Gary's 36 car ended up totalled. Gary went over, on the track, and gave him a talking to...and it ended with Gary's forgiveness of the incident and a handshake. That kind of stuff can truly influence a young driver, but in this case, this wierd pack mentality thing seems to be overriding everything else. When a 14 yr old kid is pulling this kind of stuff, and its being condoned by the teams elders, well...someone's screwed up...and I'm not talking about at the racetrack.
(not to mention this is a bit of a black eye on the Krown Jrs - Didn't both the Jacobs guys come through that program? And isn't promoting sportsmanship a big part of that program?)
Anyway, I get it that stuff happens in the heat of battle, and if two drivers have a shoving match, or a few fists get thrown, I'm usually likely to chalk it up to "boys will be boys" and let it go. Not like a fist never flew in a stock car pit area before. But this time around it just sounds like outright goonery. Couple that with what happened with the 33 car last year and there's grounds for some hard discipline there.
So, Delaware's part in this is pretty cut and dried. Its all in the Delaware General rulebook under section 22: Penalties. I guess its all a matter of whether they take their own rules seriously or not.
4. Any driver, car owner, or mechanic who takes part in any demonstration or fights on any speedway grounds before, during or after a race shall be subject to suspension, and or up to and including expulsion.
5. Until suspension is lifted, the car with which the suspended member is registered may be restricted from competing if suspension is for demonstration or fights.
7. Actions by any person participating in race events, regardless of role, at Delaware Speedway considered detrimental to association and/or stock car racing shall be subject to suspension, fine and/or expulsion.
8. Abuse, assault or threat to do bodily injury by any driver, car owner or mechanic to any official or persons serving under their orders shall be grounds for suspension, expulsion, and or fine.
How is a grown man supposed to defend himself against a 14 year old ??? You can't hit back since that would be like slapping a woman. I was not there either but from the sounds of things it was a setup between the brothers knowing that a grown man isn't going to retaliate against a kid and the older (I assume older) brother using the younger as a pick.
I agree with Shadow that fights do happen from time to time but usually, and appropriately, between drivers without additional input from crew or family. This just is bad all around and I agree it is in the tracks hands to deal with. If they don't then the driver(s) will and I don't think the track wants that to happen. All we can assume at this point by the track's silence is that it is being investigated. Something similar happened at Sunset last year. The cops were involved and if I recall correctly the track suspended the violators.
Wow, seems like the Jacobs cars should be parked, its a shame when Jaxon got wrecked, the commentators were going on about how he has a ton of talent and now he does this, the JRL does encourage sportsmanship, and watch out late model drivers, theres a couple more Jacobs in the JRL right now, truly shameful, and i believe the age rule can be ignored if a waiver is signed, but Barry Newman could've wrecked Mark Watson and Jamie Cox back in the OWM on the final nights so he could win the championship, but he didn't, i have been going out to the track since 2006, and in those years, i have figured out Barry Newman is a really classy and sportsman like driver
