Is Delaware violating the Law ?

we already have laws that deal with pay equity and this is were the violation is .

Considering the drivers/teams are not employees of the track, there's no violation there either.

No, it does not. The Charter only applies to federal legislation and programs. The Ontario Code of Human Rights would have jurisdiction, however no precedent exists there either for something like this.

i believe that this is wrong the charter applies anywhere and can be enforced by any federal court, i as a person can not infringe on someone else charter of rights, ps. pinecrest is right if this track was offering to pay men twice as much as women the cries would heard across the country. GO PHYLERS

The track is offering prize money for an event to which the contestants must pay to enter . The track is then paying out the prize money based on gender and thats where their dead in the water. imo

You wouldn't be able to infringe on someone's rights because of the laws of the province (which have to correspond to the Charter) but you as an individual aren't directly tied to the Charter.
