I have to agree with schade....if the pilot was aware of ANY problem he shouldnt have used that plane till it was fixed.

There  are very strict regulations for pilots to check over the plane they are about to fly, as well they have post operation reports to file. One of the victims  was a France family member, do you really think they where negligent in allowing a family member to die?  that would be like letting your wife take the kids to school when you know the brakes are shot on the car. It would be nice if someone on this board was a pilot or in the industry to fill us in on the regulations of pre and post flight operations. jw

Pilot is at fault as they are required to look at the airplane logs and if there is a report of something not working and it was not fixed they should refuse to operate the plane.

Pilots have to do inspections before they take off. Make sure the panel is working and nothing is failing and these checks are done in the cockpit. Checking rudders and flaps and check the tires as well on the plane. You need them to land it.

It is like a truck driver is required to do inspections and keep an up to date log but the pilots check more.

It is not like a car where the person says the GPS is not working lets turn it off. The pilot should have said no to flying it and the maintenance division shouldn't have let that plane leave.

Nascar trying to sue the makers of the plane is a joke unless they can prove that this model has had this problem in the past and others have reported it. Also the problem was reported and the plane was allowed to take off. That is not the manufactures fault and if they would have called them they would have said don't fly it till it is fixed.

The thing sounds really bad you don't check out a burning smell as a problem even if the radar system was turned off you still look into it as it might be the wiring and it wouldn't make a difference if it was switched off.

Remind me never to fly in a plane NASCAR uses.

pilot one reported the issue, pilot 2 thought it was fixed, maintenance depart did not fix it, but to paint all of nascar with this brush smacks of tabloid journalism. the people how made the call not to fix the issue should be charged with criminal negligence causing death, anyone hiding tho poor records should also be charged and any in nascar that tried to cover it up should be fired up to and including that bag of stale air, brian france, who sure is not his daddy or grandaddy
