Is Delaware violating the Law ?

I just received an email informing me that Delawares Transmission Direct Series will be paying $ 600 to win if your a male driver and $ 1100 to win if your a female driver . Apparently this is part of something the track calls the  "Kickstart Program" which is suppose to encourage diversity . I am not a lawyer but this would seem to fly in the face of the law.

   Section 28 stipulates that, "not withstanding anything in this Charter, the rights and freedoms referred to in it are guaranteed equally to male and female persons". Section 15 of the Charter of Rights and Freedoms specifically addresses equality right and states that every individual is equal before and under the law, enjoys equal protection and benefit of the law, without discrimination, including discrimination based on sex.

I don't see how you can pay one gender more then the other to win an event with out trampling all over this law . Basing the pay out of an event on gender would seem to be no different then basing it on colour , creed or religion under the laws in Canada . Can you imagine if Delaware said they had a different pay out for Blacks , Asians , Muslims and Jews ?

  I am going to assume that someone forgot to run this past the legal department and they will rectify this before the events are ever held . If they don't and assuming a male wins the event i would demand this extra money as soon as i crossed the finish line . If Delaware refuses to pay up the next step would to be to log a complaint with the Ontario Human Rights Commission who will provide you with a lawyer for free . The track on the other hand will have to lawyer up at their own expense , 10K minimum to start out with i would guess .

Heres the the toll free phone # of the Ontario Human Rights Commission  1-800-387-9080 . I never thought a government body that who dealt with the rights of a person to wear a turban on a motorcycle would have an application to racing but here it is .

I agree with you a 100% Pinecrest. Now I'm sure there will be a bunch of people coming on here saying how this is a good thing for the sport and how your wrong. this won't fly anyway.

I,m sorry that you feel this way Pinecrest but I agree with Delaware's position on this. As a matter of fact I will be racing at Barrie this year due to the fact that I will receive $2,000 to win the feature and everyone else will get $1,000. This of course is because I am of the canine species and the track is trying to encourage this type of diversity, it's called a paws on aproach. Now Pinecrest if you still believe that email that you JUST RECEIVED at 3.00am then I suggest that you get to bed earlier and catch some proper sleep. lol

I am some what surprised at your unintelligent response to a serious topic but let me set you strait on a few of things anyway .

1, You have no chance of ever collecting , $1000 for a feature win at Barrie in the old Rippington car with a crate . In fact i would bet you will be lapped at least once in the feature unless it is a caution plagued affair opening night .

2, I opened my e mail at 3 am (received) that does not mean it was sent at that time , not that it would matter. Unlike you i have been involved in racing longer then 15 minutes and verify everything or post it as rumor . In this case you can find the story several places including on Inside Tracks web site.

3, Again unlike you i have never been run out of a track for refusing to tech an engine in 40 years .

Pinecrest I agree with you on point 1 as you know I could not drive a sharp stick up a dogs ... for point 2 and 3 ? Well the jury's still out on that one. If what you say is happening at Delaware then that in its self is a low blow to female racers. I'm sure there are many out there that can race as well against any guy without the extra purse money. But if it is true then it's a less than stellar effort on the part of some track promotor. !!
