If Jill wins,Who is responsible for proving that she is in fact female?What if another driver protests that Jill was formerly a Jack,does she/he still qualify for the bonus?Racers have been known to do some rediculous things to win a small prize.
Is a bounty race also a form of discrimination?Everyone qualifies for the bonus except the driver that has the bounty on them.
Good luck to any female driver that attempts to win this huge controversial bonus.

I would imagine a simple check of a birth certificate/drivers license/government-issued ID would suffice. I'd also imagine that the answer to determining eligibility for a transgendered driver might come from previous case law on that subject.

as a rule that is correct but anyone at anytime can envoke the charter, all they need is the ability to find a court to hear them.

Assuming it falls under the jurisdiction of the court, yes. This case, however, does not.

are you saying there are areas outside the law?

I'm saying something like this falls outside of the jurisdiction of the court since it's technically not illegal. It might even be outside of the law as well (ie. not under regulations for employment, gaming or sports law), I'm not really sure.

The Ontario Human Rights Code (the “Code”) provides for equal rights and opportunities, and freedom from discrimination. The Code recognizes the dignity and worth of every person in Ontario and applies to the areas of employment, housing, facilities and services, contracts, and membership in unions, trade, or professional associations.

Individuals who are discriminated against or harassed because of gender identity are legally protected under the ground of ‘sex’. This includes transsexual, transgender, and intersex persons, cross-dressers, and others whose gender identity or expression is, or is seen to be, at variance with their birth-identified sex.

DEFINING GENDER IDENTITYGender identity is linked to an individual’s intrinsic sense of self and particularly the sense of being male or female. A person’s gender identity is fundamentally different from, and does not determine, their sexual orientation, which is also protected under the Code. A person’s gender identity may not conform to a person’s birth-assigned sex and may include the following:

Transgender or Transgendered : People who are not comfortable with, and who reject, in whole or in part, their birth-assigned gender identities. This may include people who identify as transsexual and people who describe themselves as being on a gender spectrum or continuum rather than identifying with “male” or “female”. They may or may not undergo hormone treatment and/or surgical procedures.

Transsexual : Individuals who have a strong and persistent feeling that they are living in the wrong sex. Individuals who have undergone, or who want, sex-reassignment surgery may identify as transsexuals. The term may also be used by persons who live in their self-identified gender and may have undergone hormonal transition, but who do not wish to, or cannot, undergo surgery.

Intersexed : People who are born with both male and female sex organs, or with ambiguous sex organs. This word replaces the inappropriate term “hermaphrodite”.

Crossdresser : An individual who dresses in the clothes of the opposite sex for emotional satisfaction and psychological well-being.

Remind us which part of "employment, housing, facilities and services, contracts, and membership" applies to this again...Copying and pasting means nothing unless you can demonstrate how it works.
