Exactly. When Petty Enterprises sold / merged they should have changed the number. That's what I think anyhow.
NASCAR owns and issues the numbers. The teams have the rights to the numbers while they are using them and they can trademark a certain design. The Earnhardt 3 is copyrighted and trademarked by Childress, DEI and NASCAR I believe. Most number designs are trademarked by the teams and they can use that forever even if that number gets reassigned to another team. The desicion to revoke a number from a team is as with everthing else at NASCAR's discretion. I agree if you are going to retire anything the so called 'stylized' number should be it.

...or at least kept the Petty blue with it.
As far a the No. 43 and it being a big deal to the driver, I do remember A.J. Allmendinger (the current driver of it) somewhere saying in a quote that it's a big honor to drive for the King and run that number. I can't remember the exact quote or where I heard it, but it was something along those lines.

That car just didn't look right and it is a Ford too. That only happened once before in '69, when Plymouth wouldn't give Petty a Daytona (the car with the huge wing on the back). So he quit Plymouth and ran a Torino Talladega for a year. In 1970 Plymouth created the Superbird (the other car with the 8' wing) to get him back. Petty was almost always a Mopar guy as long as they were involved in Nascar.
